Agreement to these terms

These terms apply to your use of the kendesystems.com website, operated by Kende Systems LLC, an Oklahoma limited liability company at 16901 County Road 110, Perry, OK 73077. By using the site or submitting a form, you agree to them. If you do not agree, please do not use the site.

What this page covers, and what it does not

This page covers the website: browsing it, submitting an inquiry, and calling the demo number. It is not the contract for our paid service.

If you become a client, the AI voice agent service is governed by a separate written service agreement signed by both of us. That agreement sets out scope, plan and pricing, included minutes and overage, call handling and recording, support, and cancellation. Where that agreement and this page disagree, that agreement wins.

Eligibility

You must be at least 18 and able to enter into a contract. If you are using the site for a business, you confirm you are authorized to act for it.

Quotes and pricing

• Prices shown on this site are current at the time of publication and may change.
• A quote is an invitation to discuss, not a binding offer. Nothing is agreed until both of us sign a service agreement.
• Multi-location and complex routing setups are quoted individually because they need additional configuration and sometimes more than one agent.
• Where a plan includes a monthly allowance of minutes, additional minutes are billed at the published overage rate for that plan.

The demo number

The demo number is provided so you can hear the product before you buy it. It is answered by an AI agent. Calls to it may be recorded and transcribed — see our Privacy Policy. Please do not use it to place real service calls, to transmit sensitive personal information, or for anything unlawful. Your carrier’s usual call charges apply.

Acceptable use

When using this site, you agree not to:

• Submit false information, or somebody else’s details without permission
• Attempt to interfere with, overload, probe or gain unauthorized access to it
• Use automated tools to scrape it or to submit forms
• Circumvent the security or bot-protection measures on the forms
• Use it to send unlawful, harassing, defamatory or infringing material

We may block access, without notice, to anyone doing these things or abusing the forms.

Our content

The text, design, logo and branding on this site belong to Kende Systems LLC and are protected by copyright and trade mark law. You may read, print and share pages for your own evaluation. You may not copy the content to promote a competing service, or use our name or logo to suggest we endorse you, without written permission.

Content you submit

You keep ownership of what you send us. By submitting it you give us permission to use it to respond to your inquiry and prepare your quote. You confirm you have the right to send it and that it is accurate to the best of your knowledge.

Third-party services

The site relies on third parties — Supabase, Resend, Cloudflare and Vercel — as described in our Privacy Policy. Their availability is outside our control. Any link to an external site is not an endorsement of it.

Availability

We work to keep this site and the demo number available, but we do not promise uninterrupted access to either. Both depend on hosting providers and telephone carriers we do not control, and both may be unavailable for maintenance, outages, or reasons beyond our reasonable control. Service levels for the paid product, if any, are set out in the service agreement rather than here.

Disclaimer

The website and the demo number are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by Oklahoma law.

Information on this site is general and provided for evaluation. Statistics cited are attributed to their published sources and describe the industry generally — they are not a prediction of what any particular business will experience.

Limitation of liability

To the fullest extent permitted by law, Kende Systems LLC and its members, officers and employees will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising out of your use of this website or the demo number — even if we have been advised such damages are possible.

Our total aggregate liability arising out of or relating to your use of this website and the demo number will not exceed one hundred United States dollars (US$100.00).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Some jurisdictions do not allow the exclusions above, so parts of them may not apply to you. Liability for the paid service is addressed in the service agreement, not here.

Indemnity

You agree to indemnify and hold Kende Systems LLC harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of this site, your breach of these terms, or your violation of any law or of anyone else’s rights.

Governing law and venue

These terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Oklahoma have exclusive jurisdiction over any dispute arising out of these terms or your use of this site, and you consent to venue there.

Severability and waiver

If any provision of these terms is found unenforceable, the rest stay in force and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it.

Changes to these terms

We may update these terms. The version on this page is the current one, and the “last updated” date at the top shows when it changed. Continuing to use the site after a change means you accept the updated terms.
